Shipping policy

This Shipping Policy describes how we Have A Nice Day processes and ships orders placed through our website and related services (the "Services"). This Shipping Policy is incorporated into and subject to our Terms of Service, which contain important limitations on liability and other terms that govern your use of the Services. By placing an order, you acknowledge that you have read, understood, and accepted this Shipping Policy.

Age Requirement — 21 and Over Only

All customers must be at least 21 years of age to place an order. Age is verified at checkout. By placing an order, you represent and warrant that you are at least 21 years of age and that the recipient at the delivery address is at least 21 years of age. Any liability arising from a misrepresentation of age is the sole responsibility of the person making the misrepresentation.

Order Processing Times

Orders are processed Monday through Friday, 9:00 AM to 4:00 PM Eastern Time, excluding U.S. federal holidays and any other days we may designate as closed.

  • Orders placed before 4:00 PM ET, Monday through Friday, will generally be processed the same business day or the next business day.
  • Orders placed after 4:00 PM ET, on weekends, or on holidays will be processed the next business day.
  • We do not process, ship, or deliver on Saturdays, Sundays, or holidays.

Processing times are estimates only and are not guaranteed. Orders may be delayed for any reason, including additional age or order verification, payment review, inventory availability, fraud screening, carrier issues, weather, or any other circumstance in our sole discretion. We are not liable for any delay in processing or shipment.

Regulatory Compliance

We comply with applicable federal, state, and local laws governing the sale and shipment of nicotine and vapor products. We ship only to jurisdictions where the sale, possession, and delivery of our products are lawful. We do not ship to P.O. boxes, APO/FPO/DPO addresses, or to any state, city, or zip code that prohibits or restricts the shipment of our products.

Restricted Shipping Locations

Due to state and local laws, we do not ship to certain states, cities, or zip codes. Restricted locations may change at any time without notice based on changes in law. If you place an order to a restricted location, the order will be canceled and refunded, less any applicable processing fees. It is your responsibility to confirm that the products you order are legal to purchase, possess, and receive in your jurisdiction.

Shipping Methods, Rates, and Carriers

Available shipping methods, rates, and carriers are displayed at checkout and may change at any time without notice. Carrier options, transit times, and rates may vary based on your delivery address and the products ordered.

Delivery Times

Estimated delivery times shown at checkout are estimates only and are not guaranteed. Actual delivery times may vary due to carrier delays, weather, holidays, mechanical failures, force majeure events, or any other circumstance outside our control. We are not responsible for any delay in delivery and do not offer refunds, credits, or compensation for late deliveries.

Title and Risk of Loss

Title and risk of loss for all products pass to you upon our delivery of the package to the carrier. Once we tender a package to the carrier, we are no longer responsible for the package's transit, condition, or delivery. If a package is marked delivered by the carrier but you have not received it, you must contact the carrier directly to file a claim. We may, at our sole discretion and as a courtesy, assist you in contacting the carrier, but we are not obligated to do so and we are not responsible for lost, stolen, misdelivered, or damaged packages once tendered to the carrier.

Refused or Undeliverable Shipments

Packages may be returned to us if:

  • The package is refused by the recipient;
  • The address provided is incorrect, incomplete, or undeliverable;
  • The recipient is unavailable to receive the package after the carrier's permitted delivery attempts;
  • The carrier is unable to complete delivery for any other reason.

In any such case, you may be eligible for a refund of the product cost only, less original shipping charges, return shipping charges, and any applicable processing or restocking fees, at our sole discretion. We are not responsible for failed or undeliverable shipments resulting from customer error or recipient unavailability.

Incorrect or Incomplete Shipping Information

You are solely responsible for providing a complete and accurate shipping address and recipient information at the time of order. We are not responsible for orders shipped to an address provided incorrectly by the customer, and no refund will be issued for packages lost or undelivered due to inaccurate shipping information. If a package is returned to us due to an incorrect address, you are responsible for any reshipping fees.

Order Changes and Cancellations

Once an order has been processed or shipped, it cannot be changed or canceled. Requests to change an order or shipping address must be received and confirmed by us before the order enters processing. We make no guarantee that such requests can be accommodated.

International Shipping

At this time, we ship only within the United States, excluding restricted jurisdictions. We do not offer international shipping.

Lost or Damaged Packages

If your package arrives visibly damaged or is confirmed lost in transit by the carrier, contact us at team@letshaveaniceday.com within 7 days of the carrier's last tracking update with your order number and photos (where applicable). We will, at our sole discretion and where appropriate, assist you in filing a carrier claim or, where we determine it to be warranted, offer a replacement or store credit. Resolution of lost or damaged-package claims is at our sole discretion and is not guaranteed.

Limitation of Liability

To the maximum extent permitted by applicable law, Have A Nice Day, its owners, officers, employees, affiliates, agents, contractors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to shipping, delivery, processing times, lost or damaged packages, delivery delays, or any other matter described in this Shipping Policy. Our total cumulative liability under this Shipping Policy shall not exceed the amount you paid for the product(s) at issue. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you to the extent prohibited by law.

Changes to This Shipping Policy

We may update this Shipping Policy at any time, for any reason, in our sole discretion. The updated version will be posted on this website with a revised "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Shipping Policy.
